1. Agreement to Terms

These Terms of Service constitute a legally binding agreement between you, whether personally or on behalf of an entity ("you"), and Peconic Appraisals ("we," "us," or "our"), concerning your access to and use of the peconicappraisals.com website and any related media forms, channels, mobile websites, or mobile applications (collectively, the "Site"). By accessing the Site in any manner—whether automated or otherwise—you agree to be bound by these Terms of Service, our Privacy Policy, and any additional conditions that may apply.

We reserve the right to change these Terms of Service from time to time. By continuing to use the Site after we post any such changes, you accept the Terms as modified. The latest version will always be available on our website with the effective date.

2. Professional Services

Peconic Appraisals provides real estate appraisal services. All appraisal reports are prepared in accordance with the Uniform Standards of Professional Appraisal Practice (USPAP) and applicable state and federal laws.

Requests for quotes through the Site do not constitute a contract for services. A formal engagement letter will be provided and must be signed before any appraisal work commences.

3. Intellectual Property Rights

Our License to You

This Site and all materials available on it—including source code, databases, functionality, software, website designs, audio, video, text, photographs, and graphics (collectively, the "Content")—as well as all trademarks, service marks, and logos (the "Marks") are owned or controlled by us or licensed to us. The Site is provided solely for your personal, non-commercial use.

Unless explicitly authorized, you may not modify, copy, reproduce, republish, upload, post, transmit, translate, sell, create derivative works from, exploit, or distribute any material from the Site. You may download or print one copy of individual pages for personal, non-commercial use, provided all copyright and proprietary notices remain intact.

Your License to Us

By posting or submitting any material (including comments, photos, or videos) to us via the Site or other digital venues, you represent that you own the material or have obtained necessary permissions. You grant us a royalty-free, perpetual, irrevocable, non-exclusive, worldwide license to use, modify, transmit, sell, exploit, create derivative works from, distribute, and publicly perform or display such material.

By using the Site, you represent and warrant that: (1) all registration information you submit will be true, accurate, current, and complete; (2) you will maintain the accuracy of such information and promptly update it as necessary; (3) you have the legal capacity and agree to comply with these Terms of Service; and (4) you are at least 18 years of age.

5. SMS Messaging Terms & A2P Compliance

Program Description

Peconic Appraisals operates an SMS messaging program for appointment confirmations, reminders, rescheduling updates, and customer support communications. Messages are sent only to customers who have explicitly opted in via a dedicated SMS consent checkbox on our scheduling forms or website at peconicappraisals.com. This program complies with all applicable laws and regulations, including the Telephone Consumer Protection Act (TCPA), CTIA guidelines, and A2P 10DLC requirements.

Opt-In & Consent

Opt-in is collected via web forms with a dedicated checkbox for SMS consent. By checking this box, you agree to receive SMS messages from Peconic Appraisals. Consent is not a condition of purchase or service.

Cancellation / Opt-Out

You may cancel the SMS service at any time. Simply text "STOP" to the number that sent you messages. Upon sending "STOP," we will confirm your unsubscribe status via SMS. You will no longer receive SMS messages from us after that confirmation. To re-enroll, sign up again as you did initially.

Message & Data Rates

Message and data rates may apply. Message frequency varies based on your service usage and appointment schedule. Contact your wireless provider for questions about your text or data plan.

Carrier Liability

Carriers are not liable for delayed or undelivered messages.

Supported Carriers

Our SMS program works with all major U.S. wireless carriers including AT&T, T-Mobile, Verizon, Sprint, and most regional carriers.

Age Restriction

You must be 18 years or older to participate in our SMS program.

6. Registration & Account Security

To access certain features of the Site, you may be required to register and create an account. You agree to provide accurate, current, and complete information during registration and to maintain the confidentiality of your login credentials. You are responsible for all activities conducted under your account.

If you suspect unauthorized use of your account, notify us immediately at peconicappr@gmail.com. We are not liable for any loss or damage arising from your failure to comply with this obligation.

7. Online Commerce & Third Parties

Certain sections of the Site may allow you to interact with or purchase products or services from third-party vendors. We are not responsible for the quality, accuracy, timeliness, reliability, or any other aspect of third-party products or services. Your participation in any dealings with third parties is solely between you and that party. Peconic Appraisals shall not be responsible for any loss or damage resulting from such dealings.

Links on the Site to third-party websites do not imply our endorsement or sponsorship of those sites or the information, products, or services offered through them.

9. Limitation of Liability

In no event will we or our directors, employees, or agents be liable to you or any third party for any direct, indirect, consequential, exemplary, incidental, special, or punitive damages—including lost profit, lost revenue, loss of data, or other damages—arising from your use of the Site, even if we have been advised of the possibility of such damages.
